These Terms of Use (“Terms”) govern your access to and use of the TripMate Poby mobile application (“App”) provided by Poby Tech (“we”, “us”, or “our”). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. If you are under the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App for your personal, non-commercial travel planning purposes, in accordance with the applicable app store rules (Apple App Store, Google Play, or as otherwise distributed).

3. Account

You may need to create an account to use certain features. You agree to provide accurate information and to keep your credentials confidential. You are responsible for all activity under your account. Notify us promptly if you suspect unauthorized access.

4. Acceptable Use

You agree not to:

  • Use the App in violation of any law or regulation
  • Attempt to reverse engineer, decompile, or extract source code from the App except where permitted by law
  • Interfere with or disrupt the App, our servers, or third-party services integrated with the App
  • Use the App to transmit malware, spam, or harmful content
  • Scrape, automate, or overload our systems without our prior written consent
  • Impersonate another person or misrepresent your affiliation

5. AI-Generated Content

The App may use artificial intelligence (including the Google Gemini API) to generate itineraries and suggestions. AI output may be inaccurate, incomplete, or unsuitable for your situation. You are solely responsible for verifying travel plans, bookings, safety, and compliance with local laws before relying on any content from the App.

6. Subscriptions and Purchases

In-app purchases and subscriptions may be processed through third parties such as RevenueCat and the applicable app store. Pricing, renewal, cancellation, and refunds are governed by those platforms’ terms and policies in addition to these Terms. Features available with a subscription may change; we will use reasonable efforts to communicate material changes where required.

7. Third-Party Services

The App may integrate third-party services (for example, maps, payments, and analytics). Your use of those services may be subject to separate terms and privacy policies. We are not responsible for third-party services or content.

8. Intellectual Property

The App, its branding, and our content are owned by Poby Tech or our licensors and are protected by intellectual property laws. These Terms do not grant you any rights to our trademarks or other proprietary materials except the limited license in Section 2.

9. Disclaimer

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, Poby Tech and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the App. Our total liability for any claim arising out of these Terms or the App will not exceed the greater of (a) the amount you paid us for the App or subscriptions in the twelve months before the claim or (b) one hundred U.S. dollars (USD 100), if you paid nothing.

11. Indemnity

You agree to defend and indemnify Poby Tech and its affiliates against any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the App at any time, with or without notice, for conduct that we believe violates these Terms or harms other users, us, or third parties. You may stop using the App at any time. Provisions that by their nature should survive will survive termination.

13. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms in the App or on our site and update the “Last updated” date. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
